About these terms

These terms apply to the setmap iPhone app and the setmap.dustbox.dev website. In these terms, "setmap", "we" and "us" mean setmap, the maker of the app, based in Australia. By downloading or using setmap, you agree to these terms. If you don't agree, please don't use the app.

Because setmap is downloaded from the App Store, Apple's Standard Licensed Application End User License Agreement also applies. If anything in these terms conflicts with it, these terms apply to the extent the law allows.

Using setmap

We give you a personal, non-exclusive, non-transferable licence to use setmap on Apple devices you own or control, for your own non-commercial use. You agree not to:

• copy, modify, resell or redistribute the app or its content, including the exercise library and muscle maps
• reverse engineer the app, except where the law allows it
• use the app for anything unlawful

setmap is free. If we ever add paid features, we'll explain the price and terms clearly before you pay anything.

Health and safety

setmap is a training log. It is not medical, health or fitness advice. Its templates, exercise library, muscle heat maps, personal-record badges and comparisons with past sessions are for general information only. Muscle loads are estimates based on typical exercise patterns, not measurements of your body.

Strength training carries a risk of injury. Before starting or changing a training program, talk to a doctor or qualified professional, especially if you have an injury, medical condition or are pregnant. Use correct technique, use a spotter or safety equipment for heavy lifts, and stop if you feel pain, dizziness or discomfort. You train at your own risk.

Your data

Everything you enter into setmap belongs to you. It is stored only on your device, as described in our Privacy Policy. We don't hold a copy, so we can't restore data if your phone is lost, reset or replaced, or if the app is deleted. Use Export to keep your own backup of your history.

When you import a file, you're responsible for having the right to use it. When you share a workout image or export file, you're responsible for where you send it.

Our content

The setmap name, logo, design, illustrations, muscle maps and exercise library are owned by us or our licensors and are protected by intellectual property laws. These terms don't give you any rights to them beyond using the app as described here. You're welcome to share images of your own workout summaries.

Updates and availability

We may update setmap to add, change or remove features, fix problems or keep it compatible with new versions of iOS. We can't promise that the app will always be available, error-free or supported on every device, and we may stop offering it. Because your data is stored on your device, it won't be deleted if we stop offering the app, but we recommend keeping an export.

Australian Consumer Law

Nothing in these terms excludes, restricts or changes any consumer guarantee, right or remedy you have under the Australian Consumer Law or other laws that can't lawfully be excluded. Where our liability for failing to meet a guarantee can be limited, we limit it, at our option, to supplying the service again or paying the cost of having it supplied again.

Disclaimer

Subject to the section above, setmap is provided "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, including that the app is fit for a particular purpose, accurate, or free of errors or interruptions.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any injury, loss of data, loss of profit or other loss arising from your use of, or inability to use, setmap. This includes injuries from exercise and data lost from your device. Where liability can't be excluded but can be limited, our total liability to you is limited to the amount you paid for the app, if any.

Apple

These terms are between you and us, not Apple. Apple is not responsible for setmap or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, or intellectual property claims. If setmap fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

Ending these terms

You can stop using setmap at any time by deleting the app. If you seriously breach these terms, your licence to use the app ends. The sections on health and safety, our content, the disclaimer and limitation of liability continue to apply after that.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the date at the top of this page. If a change is significant, we'll also let you know in the app. If you keep using setmap after a change, you accept the updated terms.

Governing law

These terms are governed by the laws of Australia. You and we agree to the non-exclusive jurisdiction of the courts of Australia. If you are a consumer living elsewhere, you also keep any protections given to you by the mandatory laws of your country.
